1. THE ONE THING
The Supreme Court’s June 4 decision in FCC v. AT&T preserved the FCC’s ability to issue initial forfeiture orders without a jury. It did not make those findings conclusive: a later collection action provides a de novo trial. Supreme Court opinion. The governance lesson is to distinguish an agency’s initial penalty assessment from final adjudication. X Corp.’s petition to modify its FTC order, covered below, separately illustrates continued disputes over settlement obligations. Coverage is thin on June 7 and June 11.
2. REGULATORY ROUNDUP
📋 ENFORCEMENT · ⏫ NEW | Supreme Court upholds the FCC’s initial forfeiture procedure. The Seventh Amendment permits an initial agency forfeiture order because a later collection action allows a de novo jury trial; the agency’s findings are not conclusive. Source

5. WHAT'S BEING ARGUED
💬 DATA PROTECTION · ⏫ NEW | California's AB 412: Impossible encryption mandates vs. government access demands. EFF argues the law sets an unachievable technical bar—requiring backdoor-proof encryption while mandating government decryption capability. Industry counters that such standards are necessary to prevent abuse; regulators contend encryption must yield to lawful investigation. The debate hinges on whether strong encryption and state access can coexist. Source
💬 PLATFORM GOVERNANCE · ⏫ NEW | "Move fast, surveil things": Iteration speed vs. privacy-first design. Tech platforms claim rapid iteration drives growth and innovation; critics counter that "move fast" governance enables systemic data harvesting before privacy review occurs. EFF documents AWS and other cloud platforms' role in accelerating surveillance infrastructure. The tension: velocity as competitive advantage vs. privacy as structural requirement. Source
💬 AI GOVERNANCE · ⏫ NEW | Insurers face rising regulatory expectations with no prescriptive rules. Regulators (state insurance commissioners, FTC) are demanding AI governance controls; insurers argue lack of clarity on standards makes compliance uncertain. Hinshaw & Culbertson notes the accountability paradox: expectations rise faster than guidance. The divide: prescriptive regulation vs. principles-based frameworks. Source
